SUMMARY STATEMENT:
Ordinance Number 3202 updates the commercial portions of the City's zoning code.  The draft code update includes, but is not limited to, the following items: the consolidation of the commercial zoning districts into one chapter; the creation of a Central Business District and an Office/Commercial District; and the elimination the Commercial Warehouse District.  The six commercial districts, if the proposal is adopted, will be named: Central Business, Downtown Commerce, Regional Commercial, Office/Commercial, General Commercial and Neighborhood Commercial.  The revamping of the commercial districts includes major updates to the list of permitted uses and the development standards.
The matter was heard by the City Council at their April 12, 2012 regular meetings.  At that meeting, a motion passed to direct the City Attorney to bring back an ordinance to the City Council to adopt the Commercial Zoning Code Update.  This is one of two ordinances that will adopt the commercial.  This ordinance adopts zoning code text amendments; Ordinance Number 3203 adopts zoning map amendments.
   
RECOMMENDED ACTION:
Motion to adopt Ordinance Number 3202.

The attached Ordinance No. 3202 does have some changes from the Draft ordinance reviewed by the City Council at their April 12 meeting.  They are:
Page 15, Table 19.44.020-1 listed the following use: "Stand-alone liquor store per RCW _______."  The State did not develop a definition for "stand-alone liquor store" so the RCW reference does not work.  In Ordinance Number 3202 the RCW reference is deleted and a staff developed definition is added on Page 10.  It reads:
 19.09.597 Stand-alone liquor store
Stand-alone liquor store means a business that has a spirits retail license per WAC 314-02-106 and WAC 314-02-107 whose primary stock in trade is alcohol beverages such as spirits, wine and beer.
 
Page 18, Table 19.44.020-1 - The use "pet grooming" is added near the bottom of the table.  With this add, pet grooming is allowed in all of the commercial districts.  Also, in the earlier draft, "Small animal clinics or veterinary hospitals" were not listed as permitted in the Office/Commercial District.  In Ordinance Number 3202, the use is shown as permitted in the O/C district.  This means the existing small animal clinic located on 14th Avenue will not become a non-conforming use.
